Abstract

In Islam and Iranian law, some of the rights and obligations are for the husband, some of them are for the wife, and some are shared between the husband and the wife. The basis of codifying the rights between couples is based on the inherent differences between the two sexes. In Islam and Iranian law, regarding the rights of the wife, two types of financial and non-financial rights have been emphasized, and knowing these two rights is necessary for couples; Because today, one of the important causes of family breakdown is ignorance of the duties and mutual rights of spouses and laziness in fulfilling them. As a result, observing the mutual rights between spouses strengthens and lasts the common life. Although the marriage contract is a non-financial contract, some of these effects are financial and some are non-financial. In this research, we will focus on the specific financial rights of the wife. Financial rights are rights that can be converted into money. The financial rights of the wife, which the husband is obliged to observe, include: the right to alimony, the right to doher (kinds of doher), the right to dowry, inheritance, inheritance, etc. In addition to legal articles, Iranian law has stated the financial rights of the wife in accordance with Islam. This article tries to investigate the financial rights of the wife in Iranian law with a descriptive-analytical method. Of course, it is worth mentioning that Islam and Iran's laws, in addition to giving independence to women, have also given her the right to own property and economic issues, and in this regard, she is given independence, so that a wife can He can be the owner of his achievements and take possession of his property in any way he wants.
