Abstract

Women's judgment has always been discussed in Islamic jurisprudence since a long time ago. In relation to the judgment of women, considering the richness of the teachings of the religion of Islam and leaving open the bright windows of ijtihad according to the Qur'an, Sunnah, reason and consensus, the light of guidance is always clear that by examining the above sources, the truth about this issue is also revealed. will be This article tries to investigate the judgment of women in Islamic jurisprudence with a descriptive-analytical method. The discussion of women in the position of judges has always been one of the controversial issues in different eras, where some jurists believe that women's judgment is permissible and others believe that it is not permissible for women to judge. In this research, we address this issue. In the last four centuries, some Shia jurists have raised doubts about the general condition of masculinity in a judge. According to them, the reasons mentioned from the book, tradition and reason for the validity of this condition are not convincing; Therefore, they have not approved this condition in general. Therefore, there is no obstacle for women to be judges. In fact, jurists and commentators, citing some verses of the Holy Qur'an and some narrations of the Innocents (PBUH), have clearly commented on the permissibility of judging for women. Therefore, it is not obtained from the Quran and Sunnah that this responsibility was entrusted to men.
